Terms and Conditions

The Service is currently operated by Joe Ash and Gareth Tyler trading as Official Golfing. References to "we", "us" and "our" mean Official Golfing.

Club

a golf club that subscribes to the Service to manage its membership, competitions and operations.

Member

an individual who holds an account on the Service, typically a member of a Club.

Content

any data, text, images, scores, bookings or other material submitted to or generated through the Service.

WHS

the World Handicap System operated under licence by recognised Golfing Unions.

Golfing Unions

the national golf unions that license access to the WHS Platform, such as Wales Golf and equivalent bodies across the UK and Ireland.

CDH Number

your unique identifier on the Congu Database of Handicaps.

To use the Service you must:

• Be at least 16 years old, or have parental consent and be managed under a Club's administration
• Provide accurate registration information and keep it up to date
• Choose a strong password and keep your login credentials confidential
• Not share your account with any other person

You are responsible for all activity that occurs under your account. Notify us immediately at support@officialgolfing.com if you suspect any unauthorised use.

Official Golfing provides software for golf clubs and their members, including features that may include membership management, tee booking, competition entry, scoring, handicap administration, communications and related tools.

We are continually improving the Service. We may add, change or remove features at any time. We will give reasonable notice of material changes where practical.

If your Club uses the Service, your Club is responsible for:

• Managing your membership record and permissions
• Setting competition rules, fees, and booking policies
• Communicating directly with you on club matters
• Acting as data controller for your member data, as set out in our Privacy Policy

We are responsible for providing the Service itself and operating the platform on which your Club's data sits.

Some features are paid for by your Club under a separate agreement with us. Where you, as a Member, pay fees directly (for example competition entry, casual bookings, or premium features), payment is taken through third-party payment providers, currently SumUp and/or Stripe, and any other payment provider we engage from time to time.

Where you pay using a digital wallet (such as Apple Pay or Google Pay) or a buy-now-pay-later option (such as Klarna), the transaction is still routed through our payment provider.

All fees are stated inclusive of VAT where applicable. We do not store full payment card details.

Refunds are at the discretion of your Club for Club-set fees, and at our discretion for fees paid to us directly, subject to your statutory rights under the Consumer Rights Act 2015.

Where you hold an official handicap, certain data must be shared between your Club, Official Golfing and the relevant Golfing Union to operate the WHS. This includes your name, date of birth, gender, email, CDH number, home club, handicap and score history.

You agree to provide accurate information to your Club and to us, and to comply with the rules of golf and the WHS as published by the relevant Golfing Union.

We are not responsible for handicap calculations, decisions, sanctions or disputes arising from the WHS itself; these are the responsibility of your Club and the relevant Golfing Union.

You agree not to:

• Use the Service for any unlawful purpose or in breach of any applicable law
• Upload or share Content that is defamatory, harassing, obscene or otherwise objectionable
• Attempt to gain unauthorised access to any part of the Service, other accounts, or our systems
• Reverse engineer, decompile or attempt to extract the source code of any part of the Service, except where permitted by law
• Use automated means (bots, scrapers) to access the Service without our prior written consent
• Submit knowingly false scores, identity information, or competition entries
• Interfere with or disrupt the Service, including by introducing malware
• Use the Service to send unsolicited communications to other users
• Resell, sublicense or commercially exploit the Service or any Content (other than your own) without our consent

You retain ownership of the Content you submit. By submitting Content you grant us, and your Club, a worldwide, royalty-free, non-exclusive licence to host, store, copy, transmit and display that Content as necessary to operate the Service and to provide it to you and your Club.

You are responsible for ensuring your Content is accurate, lawful, and does not infringe the rights of any third party.

The Service, including its software, design, branding, text, graphics and underlying technology, is owned by us or our licensors and is protected by intellectual property laws.

We grant you a limited, revocable, non-transferable, non-exclusive licence to use the Service for its intended purpose. No other rights are granted.

The Service integrates with third-party services, including app store platforms, payment providers, the WHS Platform, mapping services and analytics. Your use of those third-party services is subject to their own terms and privacy policies. We are not responsible for the acts, omissions or content of any third party.

If you download our app from the Apple App Store or Google Play, your use of the app is also subject to the relevant store's terms. You acknowledge that Apple and Google are not parties to these Terms and are not responsible for the app or for any support, refund or claim in connection with it.

We aim to keep the Service available 24/7 but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, security, or for reasons outside our control. We will give reasonable notice of planned downtime where practical.

We may modify, suspend or discontinue any part of the Service at any time.

We may suspend or terminate your access if:

• You breach these Terms or our acceptable use rules
• Your Club instructs us to do so in respect of your membership
• Your Club ceases to subscribe to the Service
• We are required to do so by law

Our handling of personal data is described in our Privacy Policy. By using the Service you confirm you have read and understood that Policy.

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all implied warranties, conditions and terms not expressly set out in these Terms.

We do not warrant that the Service will be error-free, uninterrupted, or that it will meet every requirement you may have. We do not warrant the accuracy of handicap calculations performed by the WHS Platform, course information supplied by your Club, or any other third-party data.

Nothing in these Terms limits or excludes our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot lawfully be limited or excluded

Subject to the above, and to the fullest extent permitted by law:

• We are not liable for any loss of profits, loss of business, loss of goodwill, loss of data, or any indirect or consequential loss
• Our total aggregate liability to you in respect of any claims arising out of or in connection with the Service is limited to the greater of (a) the total fees paid by you to us in the 12 months immediately preceding the event giving rise to the claim, or (b) £100

You agree to indemnify us against any losses, damages, costs and expenses (including reasonable legal fees) we incur arising from your breach of these Terms, your Content, or your misuse of the Service. This clause does not apply where you are using the Service as a consumer.

Our handling of personal data is described in our Privacy Policy. By using the Service you confirm you have read and understood that Policy.

We may update these Terms from time to time. The updated version will be posted on our website and in the app, with the "Effective from" date on the cover amended. For material changes we will notify you by email or in-app message and, where required by law, seek your acceptance before the changes take effect.

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
